1. Service Description
eAI Examiner (“the Service”) is an AI-powered assessment platform designed for educational institutions. The Service enables teachers to generate question papers, evaluate student answer sheets using artificial intelligence, track curriculum coverage, and provide performance analytics to teachers, principals, and parents.
2. Acceptance of Terms
By accessing or using the Service, you agree to be bound by these Terms of Service. If you are using the Service on behalf of an educational institution, you represent that you have authority to bind that institution to these terms. If you do not agree, you must not use the Service.
3. Acceptable Use
The Service is intended exclusively for educational assessment purposes. You agree not to:
- Use the Service for any purpose other than educational assessment and evaluation.
- Attempt to reverse-engineer, extract, or replicate the AI models or evaluation algorithms.
- Upload content that is illegal, harmful, or violates third-party intellectual property rights.
- Share login credentials or allow unauthorised access to your institutional account.
- Use automated tools to scrape, crawl, or overload the Service.
4. Account Responsibilities
Institutional administrators are responsible for:
- Creating and managing user accounts for teachers, students, and parents within their institution.
- Ensuring all users comply with these Terms of Service.
- Maintaining the confidentiality of admin credentials and API keys.
- Obtaining necessary parental consent for student accounts where required by law.
5. Intellectual Property
- Your content — questions, answer sheets, and evaluation data you create or upload remain the property of your institution.
- AI-generated content — question papers and evaluation reports generated by the Service are licensed to your institution for educational use. The underlying AI models and algorithms remain the property of their respective providers.
- Platform — the eAI Examiner platform, branding, and proprietary features are owned by eAI Examiner and protected by applicable intellectual property laws.
6. Limitation of Liability
AI-powered evaluation is provided as an advisory tool. Final grades and academic decisions are the sole responsibility of the teacher or institution.
To the maximum extent permitted by law, eAI Examiner shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of or inability to use the Service, including but not limited to errors in AI-generated evaluations, data loss, or service interruptions.
7. Service Availability
We target 99.9% uptime for the Service. Planned maintenance will be communicated at least 48 hours in advance via email to institution administrators. We reserve the right to perform emergency maintenance without prior notice when necessary to protect the integrity or security of the platform.
8. Termination
Either party may terminate the service agreement by providing 30 days' written notice. Upon termination:
- The institution may request a full data export (JSON/CSV) within the notice period.
- All institutional data will be permanently deleted within 30 days after the termination date.
- eAI Examiner may terminate accounts immediately for material breach of these terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in India.
